Commercial
We provide an experienced and cost effective commercial service
in the fields of property, leasing, conveyancing and commercial
contracts generally.
Civil Litigation
The practice of the Gibraltar Court is based largely on the
English High Court as laid down by the rules of the Supreme Court.
We have over the years represented numerous local and internationally
based clients in all matters including:
Applications for Freezing and other interlocutory injunctions;
landlord and tenant actions; general property litigation; breach of
trust and fraud actions; personal injury actions; bankruptcy and
insolvency actions; banking litigation; contractual litigation;
negligence; professional negligence; judicial review; arbitration etc.
Admiralty
We have considerable experience in Admiralty proceedings.
The provisions of the Supreme Court Act 1981 in so far as they
relate to Admiralty proceedings are applied to Gibraltar by
Orders in Council. Thus the practice and procedure of the
Admiralty jurisdiction within Gibraltar is almost identical
to the Admiralty Court of England and Wales. We are experienced
in dealing with most common actions in rem arising from mortgages,
charter parties, management contracts, necessaries claim, etc.
In particular we regularly deal with crews’ claims having
represented the interest of international associations in
Gibraltar for several years.
Costs
Litigation by anyone's standards can be an expensive affair.
Sometimes commercial considerations outweigh the advantages of
proceeding through the court system. We pride ourselves in our
ability to judge when aggressive litigation is required and when
it should be tempered with other commercial considerations. We
believe our sensitivity to our client's commercial needs plays
a large part in our success in increasing our client base and
ensuring client loyalty.
